1. Definitions
Throughout these Terms and Conditions, the following words carry the meanings set out below:
- "Ngon Lok", "we", "us", "our"
- — refers to Ngon Lok Senior Living Residence, located at 15 Tai Tam Road, Stanley, Hong Kong.
- "Resident" / "You" / "Your"
- — a person who resides at or receives services from Ngon Lok, or a family member or representative acting on their behalf.
- "Services"
- — the residential, social, cultural and lifestyle programmes offered by Ngon Lok, including Companion Circles, Cultural and Recreation Studio, and the Residence and Lifestyle Plan.
- "Agreement"
- — these Terms and Conditions together with any signed Residency Agreement, Service Enrolment Form, or written correspondence confirming your arrangement with us.
- "Website"
- — our online presence at ngon-lok.info and any related pages operated by us.
2. Acceptance of Terms
By enquiring about, enrolling in, or making use of our Services, you confirm that you have read and understood these Terms and agree to be bound by them.
Where a Resident is unable to act independently, a family member, legal guardian or holder of a valid Power of Attorney may accept these Terms on their behalf. By doing so, that person confirms they have the authority and capacity to enter into this Agreement.
We ask that anyone using our Services is aged 18 or above, or is accompanied and represented by an adult with appropriate authority.
3. Service Description
Ngon Lok is a non-medical senior living residence in Stanley, Hong Kong. We offer a calm and social environment for older adults who value their independence and wish to stay engaged with community life.
Our current Services are:
- Companion Circles — small, hosted social gatherings across the week, including tea, card games, mahjong and shared conversation. HK$960 per month.
- Cultural and Recreation Studio — a weekly programme of calligraphy, Cantonese opera listening, music sessions and craft afternoons. HK$2,140 per month.
- Residence and Lifestyle Plan — a furnished room with housekeeping, laundry and full dining, with open access to all social and garden activities. HK$3,720 per month.
Ngon Lok does not provide medical, nursing or clinical care. Residents requiring medical support should arrange this independently with qualified healthcare providers.
Availability of specific programmes and rooms is subject to capacity. We will inform you of availability before confirming an arrangement.
4. User Responsibilities
We ask everyone at Ngon Lok to help maintain the warm and considerate atmosphere we value. In particular, Residents and their visitors agree to:
- Treat fellow residents, staff and visitors with courtesy and respect at all times.
- Comply with the house guidelines provided at the time of enrolment or check-in.
- Keep personal spaces tidy and report any maintenance concerns promptly.
- Not bring onto the premises any substances, items or equipment that may pose a risk to others.
- Provide accurate information when registering and inform us of any relevant changes in health or circumstances.
- Use our Website and any online enquiry tools honestly and only for lawful purposes.
We reserve the right to withdraw Services where these responsibilities are not met, following a reasonable discussion with the Resident or their representative.
5. Intellectual Property
All written content, images, branding, programme materials and design elements on the Ngon Lok Website and in our printed materials belong to Ngon Lok or are used with permission. Nothing in these Terms transfers ownership of that material to you.
You may view and print content from our Website for your own personal, non-commercial use. You may not reproduce, adapt, distribute or use our content commercially without prior written consent.
Any feedback, suggestions or ideas you share with us may be used to improve our services without creating any obligation on our part.
6. Payment Terms
All fees are quoted and payable in Hong Kong Dollars (HKD). Applicable monthly rates are listed in your Service Enrolment Form and on our Website at the time of booking.
6.1 Billing Cycle
Monthly fees are payable in advance, on or before the first of each calendar month. We will provide a written invoice at least seven days before the due date.
6.2 Payment Methods
We accept bank transfer to our designated Hong Kong account, cheque payable to Ngon Lok, and such other methods as we may notify you of from time to time.
6.3 Late Payment
If payment is not received within 14 days of the due date, we may suspend access to optional programmes while the amount remains outstanding. We will always contact you before taking any such step.
6.4 Fee Changes
We may review our fees from time to time. We will give you at least 30 days' written notice before any change takes effect.
6.5 Refunds
If you give notice to leave or withdraw from a Service during a month, fees paid for days not yet used will be calculated on a pro-rata basis and returned to you within 14 working days, less any reasonable administrative costs. Deposits, where applicable, are refundable subject to the condition of the room and any outstanding amounts owed.
7. Residence-Specific Terms
The following additional terms apply to Residents enrolled in the Residence and Lifestyle Plan.
7.1 Occupancy
Rooms are provided for the use of the named Resident only. Overnight guests require advance approval from the management team.
7.2 Personal Belongings
Residents are welcome to personalise their room with personal items. We ask that any significant changes to the room are discussed with us first. Ngon Lok is not liable for loss or damage to personal belongings, and we encourage Residents to hold appropriate personal contents insurance.
7.3 Notice to Vacate
Either party may end the Residency arrangement with one calendar month's written notice. We ask that rooms are returned in a clean and tidy condition. In circumstances involving a sudden change in health or safety, we will work with the Resident and their family to find a considerate and practical solution.
7.4 Dining and Housekeeping
Meals and housekeeping are provided as part of the Residence and Lifestyle Plan. Specific dietary requirements should be communicated to our team in writing at the time of enrolment. We will do our best to accommodate preferences, though we cannot always cater for every combination of requirements.
8. Disclaimers
Ngon Lok is a lifestyle and social community, not a healthcare provider. Our Services are designed to support wellbeing and social connection; they are not a substitute for medical, psychiatric or nursing care.
Information on our Website is provided for general informational purposes. While we take care to keep it accurate and current, we cannot warrant that it is always complete or up to date, and you should not rely on it as professional advice.
We operate our premises and programmes with care, but we cannot guarantee that all activities will be suitable for every individual at all times. Residents are encouraged to assess their own comfort and physical readiness before participating in any programme.
9. Limitation of Liability
To the extent permitted by the laws of Hong Kong, Ngon Lok's liability to you for any loss or damage arising from the provision of our Services will not exceed the total fees paid by you in the two months immediately preceding the event giving rise to the claim.
We are not liable for indirect, consequential or special losses, including loss of enjoyment, loss of opportunity or losses arising from circumstances beyond our reasonable control (such as weather events, utility failures, or public health emergencies).
Nothing in these Terms excludes or limits our liability for fraud, personal injury caused by our negligence, or any other matter that cannot be excluded by law under Hong Kong legislation.
10. Indemnification
You agree to hold Ngon Lok harmless from any claims, losses, costs or demands arising from your breach of these Terms or your misuse of our premises, programmes or Website, except where such claims arise from our own negligence or breach.
11. Termination
Either party may end an ongoing Service arrangement with one calendar month's written notice, unless a shorter or longer period has been agreed in writing.
In cases of serious breach of house guidelines, or where the safety of other residents or staff is at risk, we reserve the right to end an arrangement more promptly. We will always seek to discuss the situation with the Resident and their family before taking any such step.
Provisions relating to payment of outstanding amounts, intellectual property, and dispute resolution will continue to apply after the end of any arrangement.
12. Dispute Resolution
These Terms and any dispute arising from them are governed by the laws of the Hong Kong Special Administrative Region.
If you have a concern about our services, we ask that you first raise it with our management team directly. We are committed to addressing concerns thoughtfully and as promptly as we can. Most matters are resolved more comfortably through an open conversation than through formal proceedings.
Where a dispute cannot be resolved informally, both parties agree to submit to the non-exclusive jurisdiction of the courts of Hong Kong.
13. General Provisions
- Entire Agreement. These Terms, together with any signed Residency Agreement or Service Enrolment Form, represent the entire understanding between us regarding the matters covered.
- Severability. If any part of these Terms is found to be unenforceable, the remaining provisions continue in full effect.
- Waiver. A failure on our part to enforce a provision on one occasion does not waive our right to enforce it on another.
- Assignment. You may not transfer your rights or obligations under this Agreement without our prior written consent. We may transfer our obligations to a successor organisation, and will notify you before doing so.
- Notices. Written notices under this Agreement may be sent by email, post or hand delivery to the addresses provided at enrolment. Notices sent by email are considered received the following business day.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the revised version on our Website and, where the change is material, we will give you at least 14 days' notice by email or in writing before it takes effect.
Continued use of our Services after any update takes effect will be considered acceptance of the revised Terms. If you prefer not to accept a change, you are welcome to end your arrangement with us in accordance with Section 11.
